GST/PST/HST applications are a burden on band administration staff. Often, the band's finance department is already overworked and understaffed to dedicate staff to the chore of filing the applications for the refund and rebate claims. More and more band administrators agree that outsourcing the entire refund/rebate application process is a win-win situation. Due to complicated tax rebate forms & ever changing tax policies and procedures, many First Nations have difficulty obtaining the full amount of the refunds to which they are entitled. Because there are set time limitations on such claims, thousands of dollars become unrecoverable to the First Nations every year. GST rates have recently decreased (twice), new HST is being implemented in Ontario & B.C. starting July 2010. This represents a greater challenge to most First Nation administration offices. In some cases, claims that were filed by First Nations have been disallowed. This does not necessarily mean that the claim will not be refunded. Often, the claim was incorrectly filed - either on the wrong form or the proper supporting documents were not sent with the claims or, the First Nation has filed a claim to which the time limits have expired. |
Many First Nation offices are under the impression that their auditors file the Refund/Rebate claims for them. Unfortunately, most auditors do not provide this service. The audit process is simply to make sure that the information provided by the band is accurate – therefore, it is in the band’s best interest to enquire with their auditors if they: a) offer the tax recovery review service b) if they file all the necessary claims on the band's behalf and c) if there is an additional charge for the service. 99% of the time, a band will be surprised to find out that it has been more than 4 years since the claims have been filed - yet they were sure that their auditors filed these claims on their behalf! It is always best to have a signing officer call CRA to get confirmation that rebate/refund claims were made.
